The crux of the matter was around the possible consequences to some accidents that occurred under his watch. It was his contention that the fact that minor consequences rose as a result of these accidents showed that he was not an under performer. DSP convinced the court that the avoidance of severe consequences was all to do with good fortune. Additionally, in the oil and gas industry, where a higher level of safety is expected, any safety transgression ought to potentially justify dismissal.
